URGENT! Armaguard is threatening your agreement!
Your delegates have made contact with us overnight with urgent and alarming concerns around Armaguard's intention to run tool box sessions to try and convince you to cancel your agreement with the Fair Work Commission (FWC) and to vote for a memorandum of understanding as a means of getting out of making the undertakings that the FWC is requesting they make in order to ensure that everyone’s wages and conditions are actually better than the award.
Do not vote yes for this!! Ensure you talk to everyone of your colleagues you come across. If the Fair Work Commission has not certified this agreement it is because they have concerns about workers being paid less than the minimum entitlements!!
The entire hold up of this process sits squarely with Armaguard not responding to the Commission's questions by due dates, and their inability to answer and commit honestly to what is being requested of them by the Commissioner. Although frustrating that this has taken so long, we would rather have a vigorous process that ensures employers are doing the right thing by workers rather than a process that allows employers to get away with certified agreements with inferior wages and conditions than the award, which is already the bare minimum.
The outstanding issue is that your employer has refused to comply with a direction of the Commission and provide an undertaking around the entitlement to overtime for part-time employees. Without this undertaking, the Commissioner does not think the agreement passes the BOOT (the Better off overall test). You can see this week's emails from the FWC and Armaguard here (take note of the lateness again of Armaguard's response and the Commission's comments around not answering the questions and further alarming observations that already committed to undertakings are now missing from Armaguard's further responses).
Based on the actions of Armaguard in recent months, Armaguard is not striking me as being an open and honest employer that wants to do the correct thing by their employees.
This is your employment and your wages and conditions at threat here. Don’t allow Armaguard to get away with it! Do not commit to anything - stand strong and say no!! They have sprung this meeting on you as they know union officials are unable to enter the workplace without 24 hours written notice by law! It is now vital that you all step up and pass on this information to your colleagues at work.
