Doctors Agreement Drafting

Congratulation on reaching agreement with the government on a new collective agreement for your wages and conditions. Over 95% of you have voted to accept the offer made by the government. You can see the announcement by the government here of this agreement here.

Now we have the process of drafting it into its final form for a formal ballot of all doctors.

When this agreement is certified your existing contract will cease to operate. Delegates have worked very hard to make sure that this agreement restores your rights that existed before the contracts were imposed on you, and the agreement will provide that Queensland Health will maintain individual employment arrangements (previously known as Tier 4C) negotiated during the introduction of high-income guarantee contracts, in accordance with the terms of those agreements.

Most of these arrangements had a negotiated term and many will be due for renegotiation or review. Queensland Health have written to each the HHS and advised them to review these arrangements(see the memo here).

However the nature of individual contracts are that they are to some extent individual. If there is something you have negotiated individually or as a group in your special conditions (item 18) in schedule 2, then these will not continue as part of your employment contract. Have a good look at these arrangements and let me know if there are arrangements that we need to try and maintain going forward.

Award modernisation process
Thanks to the action of Together members in securing a change of government and new industrial relations legislation (the Industrial Relations (Restoring Fairness) and Other Legislation Amendment Act passed this year), changes made by the former government to the Industrial Relations Act that stripped away your rights and conditions have been reversed.

As a result, the so-called "modern" awards made last year are now being restored to protect your workplace rights. The Act requires the commission to restore provisions for Senior Medical Officers into the Medical Officers award that was made last year. This is an important step to protect your baseline “safety net” entitlements before MOCA4 can be certified. To see the latest version of the modern award currently before the QIRC click here.

Consultation processes
The Premier and Minister have indicated that this government is seeking an open and consultative relationship with its medical staff and there are two issues that members have raised as important clincal and industrial issues to discuss with the government right now.

To date we have not been given enough information about either of these issues and we don’t want to see plans rolled out without appropriate input from Together members. Find out more and have your say as a Together member now.
